These Terms of Service (“Terms”) govern your use of our smartwatch products and associated services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Services.

Reverse engineer, decompile, or disassemble the smartwatch software or any part of the Services;
Use the smartwatch or Services to transmit spam, malware, or other malicious content;

4. Intellectual Property Rights

We or our licensors own all intellectual property rights in the smartwatch, including but not limited to the hardware design, software, trademarks, and copyrights. You are granted a limited, non – exclusive, non – transferable license to use the smartwatch and Services solely for the purposes permitted by these Terms.

Any content you create or upload using the smartwatch (such as health data, messages, etc.) remains your property. By uploading or sharing this content through the Services, you grant us a non – exclusive, royalty – free, worldwide license to use, store, reproduce, display, and distribute the content solely to provide and improve the Services.

We collect various types of data from your smartwatch, including but not limited to health data (such as heart rate, sleep patterns), location data, usage data, and account information. We collect this data to provide, maintain, and improve the Services, as well as to personalize your experience.

7. Termination
7.1 Termination by You
You may terminate your use of the Services at any time by deleting your account. However, if you terminate your account, all data associated with your account may be permanently deleted in accordance with our data retention policies.
7.2 Termination by Us
We may terminate or suspend your access to the smartwatch and Services at any time, without prior notice, if you violate these Terms or applicable laws. Upon termination, your rights to use the Services will immediately cease, and we will have no obligation to refund any fees paid by you.

 

8. Limitation of Liability
To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the smartwatch or Services, including but not limited to loss of data, loss of business, or personal injury. Our total liability to you for all claims arising from these Terms shall not exceed the amount you have paid to us for the smartwatch.

These Terms shall be governed by and construed in accordance with the laws of United States. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of United States.

Your continued use of the Services after the effective date of the changes constitutes your acceptance of the updated Terms.
